The jury in the Oracle v. Google case has found that Android does not infringe on the eight claims concerning two patents (RE38,104 and 6,061,520) Oracle owns. Judge Alsup has dismissed the jury, and after a long trial they are now finished in their part of the proceedings. Now, the real work for Judge Alsup begins.
The last verdict, in which the jury found that Android did infringe on the structure, sequence, and organization (SSO) of 37 Java APIs, still needs some attention, as the jury could not agree if these should be covered under fair-use rules, so Judge Alsup will have to determine that. There were also two minor infringements found in the rangeCheck code and the eight Java test files that were inadvertently included in early releases of Android.
Should Judge Alsup find that the SSO of the Java APIs is not copyrightable, Oracle will receive damages for the rangeCheck file and test files, to a maximum of $150,000 each. If the SSO portions are found to be copyrightable, all three infringements will go to a new trial to determine damages. Of course, we fully expect Oracle to appeal every decision it can, in front of any court that will listen.
In the end, it looks like Oracle won't be getting the billions of dollars they wanted, and more importantly, won't be eligible for any injunctive relief. There will be no "Oracle Tax" like we see from Microsoft after they went after OEMs (and suspiciously won't fight Google), and Oracle will have to find another way to make money in the changing tech world.
While it looks like a major victory for Google (though things aren't yet finished), we still have to pay for million dollar trials, and someone has to pay the legal fees on both sides. Google may have won today, but make no mistake -- our wallet lost. Until the software patent situation is revamped, the only real winners are lawyers.
The fate of FEMA's National Flood Plain Program (NFIP), the authority for which expires at the end of this month, seems to hinge on an FDA bill up for Senate consideration this week. ?But whether the Senate goes along with a short-term extension, or opts for a longer extension (until 2016) and reform of the NFIP depends on which (if any) FDA bill NFIP amendements are considered. Senate majority leader Harry Reid, (D-NV) has urged his colleagues to pass S 2344, a bill sponsored by Sen. David Vitter (R-LA)? and Sen. Jon Tester (D-MT)?that would extend the flood insurance program through the end of 2012. ?The intent of the simple, short-term?NFIP extension bill?is to?provide Congress breathing room to work on a long-term reauthorization bill.??However, Oklahoma Republican Sen. Tom Coburn has blocked attempts at a simple extension, saying, instead, that the Senate should opt now for a five-year NFIP reform bill, which among other things includes a provision to phase out subsidized insurance premiums on vacation and second homes. ?We can?t afford $900 million a year in subsidies to the very wealthy in this country for their?second or vacation homes,? Coburn has argued. Yesterday, Vitter introduced an FDA bill amendment more in line with Coburn's desires; one that would extend the NFIP through 2016 and make several reforms to the program?(see a?related article from?The Hill?here).Vitter's extension and reform amendment closely tracks the provisions of a House bill passed last July 12, H.R. 1309, the Flood Insurance Reform Act of 2011. ?Last week, the House added another NFIP bill to the mix, passing a 30-day extension measure that would keep the program running through June 30: the National Flood Insurance Program Extension Act (HR 5740). HR 5740 would extend NFIP authority one additional month until June 30. The bill (introduced by Rep. Judy Biggert (R-IL-13)) would also require FEMA and the Comptroller General to each conduct a study to assess "options, methods, and strategies for privatizing the national flood insurance program," and "for offering voluntary community-based flood insurance policy options."

"So I don't understand why our friends in the Society of St. Pius X concentrate almost exclusively on these two texts. And I'm sorry that they do so, because these are the two that are most easy to accept if we consider their canonical nature.?
Cardinal Brandmuller added that all the conciliar documents ?must be taken seriously as expressions of the living Magisterium,? while Archbishop Marchetto said that Catholics must offer ?at least an adhesion of intellect and will? to all of the documents.
?From what I have learned, there must be an acceptance of the Council by those who want to be reunited with the Church," said Archbishop Marchetto, the retired secretary of the Pontifical Council for Migrants and Travelers. "I don't think the SSPX can say, 'Well, we'll set this or that document aside.'?
Cardinal Brandmuller said that the Society of St. Pius X, like the Old Catholics after the First Vatican Council, ?have in common a rejection of the legitimate developments of the doctrine and life of the Church,? but the Society is not ?insignificant? like the Old Catholics.
?We hope that the Holy Father's attempt to reunify the Church succeeds,? added the cardinal, who offered a solemn pontifical Mass in the extraordinary form at St Peter's Basilica last May.

NEW YORK (Reuters) - It's no surprise to anyone that big investors get preferential treatment on Wall Street.
Investors expressed disappointment, scepticism and even shock on Tuesday after learning that an analyst at lead underwriter Morgan Stanley cut his Facebook revenue forecasts in the days before the company's initial public offering - information that apparently did not reach small investors before the stock went public and subsequently tumbled.
The divide between the research and retail arms of big Wall Street firms has always been deep. A former Morgan Stanley broker described the relationship as being "like Venus and Mars," an allusion to a best-selling book about the inherent differences between men and women.
As more details about Facebook's IPO emerge, investors have been finger-pointing, complaining and speculating about what's next for the company, Morgan Stanley and the Nasdaq, which had trouble executing trades on the day of Facebook began trading publicly.
Reuters reported late Monday that Morgan Stanley cautioned major clients about revised revenue expectations in the days leading up to the stock's market debut. Goldman Sachs and JPMorgan Chase, also underwriters of the IPO, cut their estimates for revenue.
Facebook shares tumbled 8.9 percent on Tuesday, closing at $31 (19.66 pounds), or more than 18 below their offering price.
"Night and day the institutional clients get things that we don't get," said a Morgan Stanley broker who found out about the revised analyst forecast second-hand from media reports published Tuesday. "It's a big issue."
"This again shows the inherent conflicts of investment banking," added Mercer Bullard, founder and president of Fund Democracy. "If they selectively disclosed to some clients and not to others, they are clearly favouring those clients over the rest."
"The allegations, if true, are a matter of regulatory concern" to the Financial Industry Regulatory Authority and to the SEC, FINRA Chief Executive Rick Ketchum told Reuters.
The Securities and Exchange Commission and the Financial Industry Regulatory Authority on Tuesday called for a review of Facebook's IPO.
"This could have been a big win for everyone and could have led to a nice resurgence of tech related IPOs," said Knox Massey, managing partner at Keith-Massey Family Investments in Atlanta. "Instead, this experience may well have soured the market for a long time."
Some mom and pop investors are grumbling, too. "I should have gotten rid of it on Friday afternoon," said a financial services salesman in New York City who asked not to be named because he works with many firms involved in the deal. "I'm pissed that it fizzled ? I'm pissed that Morgan Stanley took the wind out of the IPO's sails during the road show."
The salesman purchased Facebook stock through a Morgan Stanley adviser, receiving several thousand Facebook shares. "I should have been worried when I got six times the allocation I asked for," he said.
On the Reuters Facebook page, readers engaged in a discussion about potential class-action lawsuits for investors who lost money because their buy, sell or cancellation orders were mishandled. "Investors got SCREWED!" wrote Eric Arthur Bazaldua. "At least I still own my Farmville Farm," added Joseph C. Robles.
Not everyone thinks Facebook's prospects are dim, though. Richard Laermer, CEO of social network ThankBank and a buyer of Facebook stock at the IPO, said analysts and the financial industries are unfairly punishing Facebook for leading a new social networking bubble. "Brands that use Facebook to bring the population into understanding what the company stands for," Laermer says. "They are already seeing benefits and making money off Facebook."
Laermer says he's hanging tight. "There's no way I will ever lose money off a stock from a network with 900 million users. It's not physically possible," Laermer said.

You're never too old, or too young, to be making big mistakes when it comes to protecting your skin. Case in point: Melanoma rates are up across the board, but especially among women under 40, according to a new study by the Mayo Clinic. In fact, women under 40 are eight times more likely to get skin cancer now than they were in 1970.
Seems surprising, right? "Certainly sunscreens weren't used as much four decades ago," says lead researcher Jerry Brewer, MD, a dermatologist at the Mayo Clinic. But while people are aware of the danger of sun exposure and tanning beds, their behavior isn't changing, says Dr. Brewer.
It's not just the teenager mentality of nothing-bad-will-happen-to-me that's at play here, say experts. There are a number of misconceptions endangering everybody. Check out these skin care myths that could be putting your health at risk:?
Myth: A yearly mole check is all I need for screening.
Fact: If you're not at high risk for skin cancers, once a year is enough, says Marina Peredo, MD, a board-certified dermatologist in Smithtown, NY. But if you're fair, have a family history of melanoma, or have suffered several bad sunburns in your life, you should see a dermatologist every six months.
Myth: I should apply sunscreen as soon as I get to the beach.
Fact: Slather it on at least one hour before you enter the sun. "You need to give it a chance to absorb," says Tony Nakhla, MD, a dermatologist and author of The Skin Commandments. If you wait, you've already been exposed to harmful direct sunlight in the time it took you to walk from your car to the sand.
Myth: I need to get a base tan so I don't burn.
Fact: Pair that mentality with some fair genetics and it's a melanoma breeding ground, says Dr. Nakhla. When you give yourself a "base," you're essentially double-dipping in harmful UVA/UVB rays. There is no such thing as a base tan, tanned skin is damaged skin, and damaged skin is, well, damaged.
Myth: My skin's naturally dark and never burns so I don't need sunscreen.
Fact: "Skin cancer is color-blind," says Jeanine Downie, MD, a dermatologist in Montclair, NJ, and coauthor of Beautiful Skin of Color. In fact, skin cancer rates are increasing among Latinos. Plus, those with dark skin may not recognize the early stages of skin cancers as easily as people with light skin.

Abdel Baset al-Megrahi died at home after his health quickly deteriorated. "He has been suffering from cancer for a long time and God choose him," Khalid al-Magrahi told NBC.

Al-Megrahi was convicted in 2001 of the bombing of Pan Am Flight 103 as it flew to New York from London. All 259 people aboard the airliner were killed and 11 others on the ground in the town of Lockerbie, Scotland, died from falling wreckage.
Scotland?freed him in 2009 on compassionate grounds because he was suffering from advanced terminal prostate cancer and thought to have months to live.?

His release angered many relatives of the victims, 189 of whom were American, and the Obama administration criticized the decision.
Many speculated that a backdoor deal had been cut between the former regime of Moammar Gadhafi and the British government. With the fall of the Gadhafi regime in 2011, many in the U.S. and U.K. called on the new Libyan leaders to extradite Megrahi to serve out the remainder of his prison term, something Libya's ruling National Transitional Council refused?to do.
Lockerbie relatives: 'Never thought this day would come'
The family of convicted Lockerbie bomber Abdel Baset al-Megrahi tell NBC News that he is in a coma, without medicine and near death. NBC's Stephanie Gosk reports.
Al-Megrahi, who served as an intelligence agent during the rule of Gadhafi, denied any role in suspected human rights abuses in his home country before Gadhafi's fall and death in a popular uprising last year.?
In April, al-Megrahi's condition worsened and he was taken to a private hospital to receive a transfusion of eleven liters of blood, but subsequently felt strong enough to return home.?
Megrahi's older brother, Mohamed, said the funeral will be after the noon prayer?on Monday.?He will be buried in Al Zagawani cemetary in Janzour,?12 miles west of Tripoli. Megrahi's house?was filled Sunday with family members, relatives and neighbors paying condolences, NBC News reported.
The White House said that the death would not end the quest for justice for the families of the 270 people killed.
"Megrahi's death concludes an unfortunate chapter following his release from prison in 2009 on medical grounds - a move we strongly opposed,'' said White House National Security Council spokesman Tommy Vietor.
"We want to see justice for the victims of the Lockerbie bombing and their families. We will continue working with our new partners in Libya toward a full accounting of Gadhafi's horrific acts,'' Vietor said.
U.S. Sen. Charles Schumer on Sunday criticized the Scottish government for allowing al-Megrahi to die a free man in what he said "smelled of a deal for oil.''
Schumer, a New York Democrat, said on CNN that the death of al-Megrahi meant the full truth about the Pan Am bombing may never be known.
"Both the Scottish and British governments have not been forthcoming,'' Schumer said. "The whole deal smelled of a deal for oil for this man's freedom and that was almost blasphemy given what a horrible person he was and the terrible destruction and tragedy that he caused. I don't know if we'll ever get to the bottom of it now.''
British Prime Minister David Cameron, who was in opposition when al-Megrahi was freed, said in Chicago, where he was attending the NATO summit: "I've always been clear he should never have been released from prison.
''Today is a day to remember the 270 people who lost their lives in what was an appalling terrorist act. Our thoughts should be with them and their families for the suffering they've had."
Jim Swire, the father of one of the British Lockerbie victims, said he was convinced al-Megrahi was innocent.
''I've been satisfied for some years that this man had nothing to do with the murder of my daughter and I grit my teeth every time I hear newscasters say 'Lockerbie bomber has died,'" he told BBC News television. ''This is a sad day."

The Taliban issued a statement ahead of today's NATO summit in Chicago, expressing frustration with the coalition's moves to 'prolong the occupation.'?

Hours before the start of a major NATO summit in Chicago, the Taliban's main spokesman released a lengthy statement signaling the insurgency was open to a political solution to the conflict, but accused NATO of "wavering in their stance" on negotiations.
"The Islamic Emirate has left all military and political doors open,"?read the statement, written in English and attributed to spokesman?Zabihullah Mujahid. "[H]owever the invaders are utilizing a one step forward, two steps backwards tactic. They are conjuring artificial excuses to prolong the occupation of Afghanistan, are wavering in their stance and do not seem to have a clear strategy for a political solution."
Until NATO stops wavering, the statement continues, the Taliban considers the coalition's calls for talks to be "meaningless."
It was the Taliban who suspended negotiations in March following the burning of the Quran on a US base and a shooting spree by a US soldier.?But the United States and NATO have continued to talk of seeking a negotiated settlement to the 11-year conflict.
Most recently, President Obama backed negotiating on a visit earlier this month to Afghanistan. However, he also outlined a new strategic pact with the US-backed government in Kabul that would let some American soldiers stay in Afghanistan past 2014 until 2024.?
Obama's two-pronged message of peace talks but prolonged troop presence unsettled what appeared to be a Taliban strategy of running out the clock?on the US withdrawal target of 2014. The Taliban's statement today suggests the insurgency is irked by the move to "prolong the occupation."
Whether Mr. Obama's gambit pushes the Taliban to publicly return to negotiations remains to be seen. While today's statement signaled openness again to negotiations, it also expressed doubts about NATO's sincerity in wanting to leave.?
"The foreigners should forgo prolonging and complicating the Afghan issue for their colonialist objectives," the statement reads.
It goes on to remind NATO that, despite the 2024 extension, there are domestic pressures to wrap up the war soon. The statement cites a recent?CBS News/New York Times poll in which 69 percent of respondents?said the US shouldn't be involved in Afghanistan. Indeed, Monitor polling on the new US-Afghanistan strategic pact found nearly two-thirds of?Americans reject the broad outlines of the deal.?
The Taliban statement also reiterated the group's stance that they were not involved in the 9/11 attacks and will not allow Afghan soil to be used to launch attacks on other countries.?
"The Islamic Emirate once again declares that it holds no agenda of harming anyone nor will it let anyone harm other countries from the soil of Afghanistan hence there is no reason for the occupying countries including America to continue the occupation of Afghanistan under the pretext of safeguarding its own security," the statement reads.?
NATO helped overthrow the Taliban government in 2001 after the regime failed to hand over Al Qaeda chief Osama bin Laden in the days following the Sept. 11, 2001, attacks.?
CAMP DAVID, Md. (AP) ? Drawn together in this serene mountain outpost, leaders of the major industrialized nations are prodding Germany to balance its push for European fiscal austerity with doses of stimulus spending to avoid an economic calamity that could reverberate worldwide.
With three new members in their midst, the Group of Eight leaders will take measure of themselves as they turn their attention Saturday to reconciling the need to quell European debt crises with the desire to increase demand for goods and spur job growth.
Facing economic and political pressures at home, President Barack Obama and leaders of Germany, France, Canada, Italy, Great Britain, Russia, and Japan were huddling in the casual setting of Camp David's Laurel Lodge looking to build consensus even though a decisive plan of action seemed out of reach at this point.
The G-8 session here in this secure presidential compound nestled in Maryland's Catoctin Mountains sets the stage for a far more consequential European summit next week where eurozone members hope to come together on specific steps to fight rising debt while spurring a recovery.
Obama established the tone for the G-8 Friday after meeting with just-elected French President Francois Hollande, declaring that the aim of the summit is to promote both fiscal consolidation and a "strong growth agenda."
"President Hollande and I agree that this is an issue of extraordinary importance not only to the people of Europe but also to the world economy," Obama told reporters following the meeting.
In a hint of the pressures facing the leaders, Obama greeted German Chancellor Angela Merkel to Camp David Friday at dusk, asking her how she was. Merkel, facing resistance over her austerity push, merely shrugged.
"Well, you have a few things on your mind," Obama said sympathetically.
A central economic topic, though hardly the only one confronting Europe, is the fate of Greece which is facing the most acute financial crisis of the eurozone and is set to hold elections June 17 to end political deadlock. At issue is whether Greece abandons the euro to escape austerity measures.
Hollande, speaking with Obama at his side Friday, said: "We share the same views, the fact that Greece must stay in the eurozone and that all of us must do what we can to that effect."
Lowering expectations for the G-8, U.S. National Security Adviser Tom Donilon said: "The leaders I think will focus on specifics and specific concepts and ideas for growth and jobs. But I would also point out that the ultimate decisions on that would be decisions taken in the eurozone."
Also on the agenda is energy as the world looks to the oil markets in advance of scheduled sanctions on Iranian oil exports. While oil prices have been falling, major oil importing countries, including the U.S., are keeping a wary eye on prices and keeping open the possibility of tapping their own oil reserves.
For Obama, Europe's fate is critical to his own political survival. An economic recession that spreads to the U.S. could damage an already slow recovery and boost the argument by his Republican challenger, Mitt Romney, that the United States economy needs new leadership.
There is a get-acquainted aspect to the session as well. The Camp David gathering, the largest collection of foreign leaders ever at the presidential retreat, is the first G-8 meeting for Hollande, for Italian Prime Minister Mario Monti and for Japanese Prime Minister Yoshihiko Noda. In what has been widely viewed as a snub, Russian President Vladimir Putin is skipping the G-8, sending Prime Minister Dmitry Medvedev in his place.
The meeting comes at a turning point in Europe, marked by elections in France and Greece that signaled defiance toward the fiscal austerity measures that Merkel has pushed for the most indebted eurozone countries. European countries are straining under high borrowing rates. The drastic cuts in spending and government layoffs were designed to address massive national debts but they have also caused short-term economic distress and joblessness.
On Friday, Spain's central bank announced that the level of bad loans on the books of Spanish banks was at an 18-year high, fueling concerns about the financial sector in the eurozone's fourth-largest economy.
The emphasis on economic growth has been welcomed by Obama, who has long argued that the stimulative steps he took in 2009 put the U.S. on the road to recovery.
"Europe is still in a difficult state," Obama told donors in Seattle last week, "partly because they didn't take some of the decisive steps that we took early on in this recession."
To what degree the Europeans, and Merkel in particular, agree remains to be seen.
"With Hollande coming into play here, there is going to be a lot of pressure on Germany, not just from Hollande and Obama, but also some of the other countries ? Italy and UK ? some pressure for Germany to push more toward growth within Europe because they have to get them on board," said Jeffrey Bergstrand, a former federal reserve economist and now an expert on international finance at the University of Notre Dame.
U.S. officials have been encouraged by recent discussions in Europe to ease up some belt-tightening so that spending cuts aren't as deep or as swift and to increase spending on public works projects like roads and schools in weaker parts of Europe. They also point to Germany's recent decision to negotiate higher public sector wages, a move they say could have a positive ripple effect on demand.
Merkel herself has made conciliatory gestures, saying in a television interview this week that she was open to helping stimulate the Greek economy provided Greece honored pledges to shrink its debt.

It?s like if two members of dessert royalty got married and had babies ? the result would be these Vanilla Cupcakes in a Cone. My kids lost their minds when they got to make them with me. Where, you may ask, did this ingenious idea (which I wish I had thought of) come from?
Recently I got a copy of the new Handstand Kids cookbook, Baking Around the World, and told Kenya and Chloe that they could pick out any recipe they wanted for us to bake together. They were over the moon. Both of my kids are huge fans of the Handstand Kids and so we poured through the book together looking for a recipe while the kids talked about their favorite HK characters and looked at the cute illustrations of them throughout the book. I was getting excited myself, reading recipe names like Indian Biscuits, Raspberry Rugelach Twists, Traditional Mexican Chocolate Cake and Red Velvet Beet Cupcakes (my own little contribution to the book!) which all sounded good to the kids, but when I suggested Vanilla Cupcakes in a Cone, they were sold.
Even better, this recipe is so simple that Kenya and Chloe were able to do everything short of putting them in and pulling them out of the oven. When the cupcake cones were cooled and frosted we had a little birthday party celebration for our friend, Nilva. You should have seen the smiles on their faces and total empowerment they experienced carrying the cones with candles over to her while recounting how they had made them on their own.

Vanilla Cupcakes In A Cone (makes 12 cones)
1 1/2 Cups All Purpose Flour 1 1/2 Tsp Baking Powder 1/2 Tsp Salt 1/2 Cup Unsalted Butter, softened 1/2 Cup Sugar 1 Tsp Vanilla Extract 2 Large Eggs 1/4 Cup Unsweetened Applesauce 1/4 Cup Low Fat Milk 12 Ice Cream Cones with flat bottoms (also known as cake cones)
1. Preheat oven to 350? F. 2. In a bowl, whisk together the flour, baking powder, and salt. 3. In the bowl of a standing mixer, or using an electric hand mixer, beat the butter and sugar for about 2 minutes, or until light and fluffy. 4. Add eggs, one at a time, then the vanilla mixing to combine. 5. Slowly add half of the flour mixture and then some of the milk and apple sauce until just combined. Then add the remaining flour, milk and apple sauce, scraping down the sides of the bowl with a rubber spatula and beat until just combined. 6. Pour the batter into the ice cream cones, filling them just to the top of the cone. Place on a baking sheet and carefully place in the oven. 7. Bake for 20-25 minutes, or until the cake springs back when lightly pressed. 8. Allow to cool for 15 minutes before frosting.
Butter Cream Frosting (makes about 1 cup)
1/2 Cup Cream Cheese, softened at room temperature 4 Tbsp Butter, softened at room temperature 1 Cup Powdered Sugar 1 Tsp Vanilla Extract

Shortleaf pine-hardwood ecosystem restoration following insect outbreak
OTTO, NC--Research by USDA Forest Service Southern Research Station (SRS) scientists shows that the impacts of recent outbreaks of southern pine beetle further degraded shortleaf pine-hardwood forest ecosystems in the southern Appalachian region. The authors suggest that cutting and burning these sites reduces heavy fuel loads, improves soil nutrient status, and opens the canopy for restoration of these shortleaf pine communities.
In an article published in the June issue of journal Forest Ecology and Management, research ecologist Katherine Elliott and fellow scientists from the SRS Coweeta Hydrologic Laboratory examine the effects of three treatments to restore shortleaf pine-hardwood forests in areas where southern pine beetle attacks have killed most of the overstory pines.
Historically, frequent fire maintained the pine-hardwood ecosystems of the southern Appalachians as open grassy savannas with widely spaced oaks and shortleaf pines, a grassy understory, and relatively clear midstory. The interactions of past land use, fire exclusion, drought, and southern pine beetle outbreaks have severely impacted these ecosystems.
"Over the past century, these ecosystems have been on a trajectory of increased loss of pines in the overstory, lack of regeneration of both pines and oaks, loss of ground layer plants, and the expansion of the evergreen shrub mountain laurel in the midstory," says Elliott. "The latest outbreak of southern pine beetle, a native insect, killed more overstory pines, further damaging the ecosystem while adding fuel for fire."
For the study, the researchers selected eight 12 to 15-acre study sites in pine-hardwood ecosystems where a large number of the pines had been killed by southern pine beetle. They tested the effects of burning only, cutting and burning on sites with droughty soils, and cutting and burning on sites with medium soil moisture. Two years after the treatments, they reported increased soil nutrient availability, greater herbaceous plant cover and diversity, and more native bluestem grasses.
Unfortunately, they found only a few pine seedlings in the understory after the treatments. "In our study, poor pine regeneration may have been due to drought, poor seed production, and hardwood competition in the understory," says Elliott. "Poor seed production was not unexpected, since southern pine beetles killed almost all of the overstory pines before the treatments."
The researchers found that though oak regeneration increased on all the burned sites, other hardwood species increased as well. The researchers suggest that without further intervention, oaks will not succeed into the overstory due to competition from faster growing hardwoods.
This study showed that cutting followed by prescribed fire can reduce fuel loads, increase soil nutrient availability, open the canopy by reducing trees in the overstory, and stimulate vegetative growth. These cut-and-burn treatments have positioned these degraded ecosystems on a restoration trajectory.
"Further silvicultural treatments are needed to fully restore these sites to shortleaf pine/bluestem communities," says Elliott. "Additional follow-up treatments could include planting pine seedlings, using thinning or herbicides to reduce competition from faster growing red maple and sassafras sprouts and shrubs, and repeated burning to maintain open woodland for native grass and other plant cover."
"Land managers need information on treatment options that will reduce the heavy fuel from dead and dying trees, and they need information on how to most effectively restore these forests," says Elliott. "We will continue to work with land managers on applying and refining these treatments in their efforts to fully restore shortleaf pine/native bluestem grass ecosystems."
"Without the partnership and support from the National Forests of North Carolina, Tennessee, and Georgia this research would not be possible or as relevant," she adds. "For this study, the Ocoee Ranger District, Cherokee National Forest was responsible for implementing the treatments and they worked closely with the researchers to make it all happen." In return, researchers provide the information to the National Forest partners and others by onsite tours and workshops.
This research was partially funded by the Joint Fire Science Program, which supports scientific research on wildland fires and distributes results to help policymakers, fire managers and practitioners make sound decisions.
